Singapore: Winding-up applications against Delta Corp Shipping pile up

Latest application was filed by Japan’s NYK Bulk & Projects Carriers after Lym Holdings Ltd, Arte Bunkering Pte Ltd and Raiser International Shipping Co Limited did the same in the past few months.

Delta Corp Shipping Pte Ltd has been slapped with another winding up application after several other companies took the same action in the past few months. 

This time Japan’s NYK Bulk & Projects Carriers Ltd, a creditor of the company, filed the application in the General Division of the High Court of the Republic of Singapore on 7 August, according to a Government Gazette notice on Friday (15 August).

Delta Corp Shipping Pte Ltd is reportedly the Singapore arm of bulker operator and logistics group Delta Corp Holdings. 

Marshall Islands-registered Lym Holdings Ltd, Arte Bunkering Pte Ltd and Raiser International Shipping Co Limited also previously filed applications for the winding up of Delta Corp Shipping. 

Arte Bunkering Pte Ltd is the Singapore branch of Tallinn-based bunker and marine lube trading company Arte Bunkering OÜ, which was set up in 2020. 

According to the latest notice, the winding up application is directed to be heard before the Judge sitting in the General Division of the High Court at 10am on 29 August.

Any creditor or contributory of the company desiring to support or oppose the making of an order on the winding up application may appear at the time of hearing by himself or his counsel for that purpose.

A copy of the winding up application will be furnished to any creditor or contributory of the company requiring the copy of the winding up application by the solicitors of the applicant’s, Allen & Gledhill LLP, on payment of the regulated charge for the same.

The Applicant’s address is Yusen Building (12F), 2-3-2, Marunouchi, Chiyoda-ku, Tokyo 100-0005, Japan.

The Applicant’s solicitors are Allen & Gledhill LLP of 1 Marina Boulevard, #28-00, One Marina Boulevard, Singapore 018989.

Note: Any person who intends to appear on the hearing of the said winding up application must serve on or send by post to the abovenamed Allen & Gledhill LLP, Solicitors for the Claimant, notice in writing of his intention to do so. The notice must state the name and address of the person, or, if a firm, the name and address of the firm, and must be signed by the person, firm, or his or their solicitor (if any)  and must be served, or, if posted, must be sent by post in sufficient time to reach the abovenamed not later than the 25th day of August 2025 (3 clear working days before the day appointed for the hearing of the winding up application).

In November 2024, Shipping Watch reported Lym Holdings claiming that Delta Corp Shipping ran from a time charter contract after chartering a ship. Delta Corp declined to comment at the time. 

Another article in October 2024 reported that NYK Bulk & Projects Carriers, an affiliate of NYK Group, secured court orders to seize assets of Delta Corp Shipping over allegations that it breached a charter contract.

Singapore: Coastal Logistics Pte Ltd to be wound up voluntarily

Several resolutions for Coastal Logistics Pte Ltd were made during an extraordinary general meeting held on 14 July, according to a notice in the Government Gazette on Friday (4 July).

The following resolutions were duly passed during the meeting:

As Special Resolution

  • That it has been proved to the satisfaction of the meeting that the Company cannot by reason of its liabilities continue its business and accordingly the Company be wound up voluntarily pursuant to Section 160(1)(b) of the Insolvency, Restructuring and Dissolution Act 2018 (No. 40 of 2018);

As Ordinary Resolutions

  • that Mr. Wong Pheng Cheong Martin and Ms. Koay May Yee, both care of FTI Consulting (Singapore) Pte Ltd, One Raffles Quay, #27-10 South Tower, Singapore 048583 be appointed as the joint and several Liquidators of the Company for the purpose of such winding up; and
  • that the Liquidators be at liberty to open, maintain and operate any bank account(s) or account(s) for monies received by them as Liquidators with such bank(s) as they deem fit; and
  • that a Committee of Inspection will not be formed.

Manifold Times previously reported Nicholas James Gronow, director of Heng Tong Fuels & Shipping and Coastal Logistics, filed statutory declarations for both companies stating the firms cannot continue their businesses due to liabilities.

Both companies were reportedly affiliated with troubled Singapore bunker player Coastal Oil (Singapore) Pte Ltd. 

In 2019, several vessels owned by both firms entered the sale & purchase (S&P) market in Singapore.
